Please read these Terms and Conditions carefully before placing an order. By purchasing products from MIQALab GmbH (“Seller”, “we”, “us”), you (“Buyer”) agree to accept these terms. If you do not agree, you must not purchase products or services from us.
These Terms may be updated at any time without prior notice. The latest version will be available on our website.

| Scope and Applicability |
These Terms and Conditions apply to all sales and services of PlastiTrax® products, including reference materials, test samples, and analytical services. The latest version is available on our website and may be updated at any time.
All sales are conducted exclusively on a B2B basis. No sales to consumers.

| Delivery times |
Delivery times depend on the order volume and selected products. Orders are typically shipped within 5 business days. In cases of limited stock availability or larger order quantities, the delivery time may extend to up to 3 weeks.

| Shipping and Delivery (DAP – Incoterms® 2020) |
Delivery shall be made under Delivered at Place (DAP – Incoterms® 2020) to the destination specified by the Buyer.
The Seller shall arrange for the carriage of the goods to the agreed place of destination and shall bear all risks associated with the transport until the goods are made available for unloading at such destination.
The Buyer shall be responsible for all import duties, taxes, customs clearance, and any other charges related to importation.

Notwithstanding the allocation of responsibilities under DAP (Incoterms® 2020), all transportation costs incurred by the Seller for delivery to the agreed destination shall be invoiced to and borne by the Buyer, unless otherwise agreed in writing.

Risk of loss or damage to the goods shall transfer from the Seller to the Buyer once the goods are made available for unloading at the named place of destination, in accordance with DAP terms.

| Order Acceptance and Cancellation |
Order confirmation does not constitute acceptance. We reserve the right to accept, reject, or modify any order at our sole discretion.
Orders cannot be cancelled once confirmed, except in cases of substantial delivery delays. If payment has been made and the order is cancelled, a refund will be issued.

| Product Information and Availability |
All products are subject to availability. We reserve the right to modify or discontinue products without notice.
PlastiTrax® products are scientifically characterized reference materials. Exact particle numbers per polymer are indicated on product labels.

| Analytical Services |
MIQALab provides analytical services, including microplastic analysis, method development, validation, and QA/QC implementation.
All analytical results are generated using established scientific methodologies and internal quality control procedures. However:
Results may vary due to sample composition, preparation, and methodological limitations
No guarantee is made regarding reproducibility across laboratories
No guarantee is made regarding regulatory compliance unless explicitly agreed

All analytical services are provided for research and informational purposes only, unless otherwise specified in a written agreement.

| Sample Responsibility |
The Buyer is solely responsible for:
Proper sampling, storage, and shipment of samples
Compliance with all applicable regulations
Ensuring samples do not pose health, safety, or legal risks

Seller is not liable for contamination, degradation, or alteration of samples prior to receipt.
​
| Intended Use |
All products are intended exclusively for scientific research, method development, and analytical validation.
Products are not intended for medical, pharmaceutical, food, or environmental release applications.

| Warranty Disclaimer |
ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
ACCURACY OR RELIABILITY OF ANALYTICAL RESULTS

Buyer assumes full responsibility for testing and evaluating suitability for their intended use.

| Limitation of Liability |
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Seller’s total liability is limited to the amount paid for the product or service
Seller shall not be liable for indirect, incidental, or consequential damages

This includes, but is not limited to:
loss of profits or data
analytical errors or misinterpretation
regulatory or compliance decisions
​
This limitation applies to both products and analytical services.
​
| Returns and Claims |
Claims must be submitted within 4 days of delivery.
Defective or incorrect products may be replaced
Returns require prior written approval
Refunds are processed within 30days after receipt
​Failure to comply with timelines voids any claims.
​​
| Force Majeure |
Seller is not liable for delays or failure due to events beyond reasonable control, including but not limited to natural disasters, supply chain disruptions, or regulatory actions.

| Governing Law and Jurisdiction |
These Terms are governed by the laws of Austria.

| Entire Agreement |
These Terms constitute the entire agreement and supersede all prior agreements. Any modifications must be made in writing and signed by both parties.
